Access to the Kondo Website is subject to the following terms of use. We would ask that you take the time to read through these before continuing to the Kondo Website.
On accessing the Kondo Website on this and on each subsequent occasion you will be deemed to have accepted all of the terms of use that apply to its use and to the facilities and services provided by it. We reserve the right to alter these terms of use at any time and it is your obligation to check if changes have been made. Your use of the Kondo Website after changes are posted on-line shall constitute acceptance of the new terms of use.
In these terms of use: "we/us/our" means Kondo Ltd; "Kondo Website" means our website at www.kondo.co.uk; "you"/"your" means the user of the online services.

Access to the Kondo Website
Access to the Kondo Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Website without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.
From time to time, we may restrict access to some parts of our Website, or our entire Website, to users who have registered with us.

In consideration of our agreeing to permit you to use the Kondo Website to search our database of properties, you agree that you will only use, reproduce and print materials comprising the results of such searches for your own personal, non-commercial purposes. In particular, you must not use the contact details provided by advertisers of properties to contact such advertisers other than in connection with a genuine enquiry relating to the purchase or rental by you of the property in question.
The pages contained in the Kondo Website may contain technical inaccuracies and typographical errors. The information in these pages may be updated from time to time and may at times be out of date. We accept no responsibility for keeping the information in these pages up to date or liability for any failure to do so.
The information contained in the material in the Kondo Website is only for information purposes. The material on the Kondo Website does not constitute advice and you should not rely on any material on the Kondo Website to make (or refrain from making) any decision or take (or refrain from taking) any action. We exclude all liability for any illegality arising from or error, omission or inaccuracy in such material.
We are not estate agents. The information relating to the properties available on the Kondo Website are provided to us by private sellers of those properties and we do not verify any of the details provided to us. If you choose to rely on the details provided by these sellers, you do so at your own risk. We recommend that you check and verify all property details with the seller before making any decisions or taking any action with regards to any property advertised on the Kondo Website.
We give no warranties, conditions, guarantees or representations, express or implied, as to:
(a) the completeness or accuracy of the advice and information contained on the Kondo Website or any website to which it is linked;

(b) the content of the advertisements for properties included in our database, including but not limited to the ownership, quality, authenticity of any photographs, videos, or compliance with description of any such properties;

(c) the completeness of the results of any search of our database or that the properties selected by the search are the only properties on our database which might meet the searcher's requirements.

All content that is uploaded to the Kondo Website will be considered to be non-confidential, and non-proprietary and we have the right to use, copy and/or distribute and disclose to third parties any such content for any purpose.

We have the right to disclose your identity to a third party if they claim or allege that content posted or uploaded by you breaches that third party’s legal rights.

The views or comments that are expressed by the users of the Kondo Website do not represent our own views or values.

Your content must not contain any material which is obscene, offensive, immoral, discriminatory or hateful, and it must not in any way infringe the intellectual property rights of any third party.

We will determine whether there has been a breach of the above terms, and if a breach has occurred the appropriate action we be at our absolute discretion. This action may include (without limitation); immediate, temporary or permanent banning from the Kondo Website; immediate, temporary or permanent removal of any content from the Kondo Website; legal action against you; or disclosure of information to the law enforcement or other appropriate authorities as we deem necessary.

We reserve the right to take down any content uploaded or posted to the site by you at any time, without warning or reason.

The Kondo Website publishes advertisements placed by third parties to advertise their properties and other goods and/or services. We do not own the properties or goods advertised for sale on the Kondo Website and have no liability for these or for any losses that you may incur as a result of purchasing a vehicle, goods and/or any services advertised by third parties. If you choose to purchase a vehicle, goods and/or services advertised for sale by third parties on the Kondo Website, the contract will be between you and the third party advertiser and not with us.

Copyright and trade marks
All rights, including copyright, in the content of these web pages and in the photographs of any properties displayed on the Kondo Website from time to time and all database rights in our database of properties, are owned or controlled for these purposes by us.
We are not liable for any failure to perform any of our obligations under these terms of use caused by matters beyond our reasonable control.
Except as expressly permitted by these terms of use, you may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any of the contents of the Kondo Website. In particular, you must not cache any of the contents for access by third parties nor mirror or frame any of the content of the Kondo Website nor incorporate it into another website without our express written permission.

Your obligations and conduct
You accept that you alone are responsible for making sure your computer and computer system are compatible with the Kondo Website, and have the relevant technology needed to use the Kondo Website.

It is forbidden to use inappropriate or offensive language or content on the Kondo Website. You must not solicit any commercial services in any form on the Kondo Website, or in any communication to or from the Kondo Website.

The material displayed on our Website is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, hereby expressly exclude:
(a) all conditions, warranties and other terms which might otherwise by implied by statute;

(b) any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our Website or in connection with the use, inability to use, or results of the use of our Website, any websites linked to it and any materials posted on it, including without limitation any liability for:

We make no warranty that the Kondo Website (or websites which are linked to the Kondo Website) is free from computer viruses or any other malicious or impairing computer programs. It is your responsibility to ensure that you use appropriate virus checking software. When you use the 'contact seller' sections to contact a seller, or enquire about a property, your details (as show on your profile) will be sent directly to the seller or the contact. We do not accept any liability for any subsequent communications that you receive directly from that person, party, or contact.

The Kondo Website contains hypertext links to websites that are not operated by us. We do not control such websites and are not responsible for their content. Our inclusion of hypertext links to such websites does not imply any endorsement of the material contained on the Kondo Websites or of the owners.

Links to the Kondo Website
You may establish a hypertext link to the home page of the Kondo Website, but not otherwise, without the need for our written consent, provided there is thereby no implied endorsement or sponsorship of you, your company or your website by us.

Registration details
To gain access to services on the Kondo Website you are required to register your details. We reserve the right to refuse registration for unsuitable candidates.

Each registration is for a single user only. You must not share you username and password with any other person or with multiple users on a network.

The information provided during registration must be truthful, accurate and complete.

You must not attempt to register in the name of any other individual, nor will you adopt any username which we deem to be offensive.

All personal information supplied by you during registration will be protected and used in accordance with the terms of our privacy policy.

You accept full responsibility for all use of, and keeping secret your own account information, ID and password that you have chosen for use on the Kondo Website. We do not accept any liability for loss of your password or account ID caused by a breakdown, error, loss of power or otherwise caused by or to your computer system.

You must notify us immediately if there is any unauthorised use of your account, or if there is any other breach or security that you become aware of.

Notices

All notices sent by email will be deemed to have been received on the day that they were sent or, if sent on a public holiday in England or on a Saturday or Sunday, the next working day following the day on which the mail was sent. All of those sent by post will be deemed to be received 3 working days after the date of posting.

If you have registered your details to use the Kondo Website we may serve a notice to you by email to the address provided at registration.
 
Customer feedback and quality

We try to ensure that all customer feedback is dealt with and recorded, quickly and fairly. We welcome criticisms and suggestions, to be sent through to info@kondo.co.uk, or by post to Kondo Ltd, Office 7, 35-37 Ludgate Hill, London, EC4M 7JN.

We will try to answer and deal with all phone calls made to ourselves promptly and fairly, calls may be recorded for training and monitoring services.
 
General

These terms may be revised at any time, and we advise you to consult them periodically to take notice of any such changes.

A waiver by a party of a breach of any provision shall not be deemed a continuing waiver. Failure or delay in exercising any rights under these terms shall not prevent the exercise of that or any other right. The provisions of the contracts (Rights of third parties) Act 1999 shall not apply to these terms.
 
We reserve the right to assign or subcontract any or all of our rights and obligations under these terms of use to a third party. If we exercise this right, we shall name the assignee or subcontractor on the Kondo Website and you will be entitled to terminate the account within 5 working days. You may not without our prior written consent assign or dispose of any rights or obligations arising under these terms of use.
These terms of use of access together with our privacy policy contain the entire agreement and understanding between the parties relating to the Kondo Website, and supersede any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either party. We exclude all representations and warranties relating to access to use of the Kondo Website, whether they are statutory or otherwise, as far as is possible by law.
If any of these terms of use shall be held to be invalid or unenforceable, it shall not affect the enforceability of any of the remaining provisions.

Information collected and what it is used for
Kondo may collect the following information about you:
? Information you provide when you place an advertisement on the Website
As part of the advert placement process we will collect your name, email address and telephone number. We will also collect your postcode in order to provide a positioning of each property within our database, this allows potential buyers to locate property for sale within a set radius of a chosen location.
If your advert expires we will use your details to contact you via phone or email to give you the option to rebook your advert.
We use certain features to protect the privacy of our customers when they are communicating via phone or email. We recommend that all customers placing an advert select Protect Your Number at the point of entering their phone number. Protect Your Number enables you to keep your telephone number private by providing you with a substitute telephone number to use in your advert. Protect Your Number automatically applies unless you opt out at the time you place your advert. Please be aware that if you opt out, your personal telephone number will be visible within your advert.
We supply a customer to customer email solution that allows people who are viewing your advert to contact you through a link on your advert without seeing your email address. We use this to strip out any potentially harmful or spurious links that may expose you to fraudulent activity. This email solution is not optional.
Payment Card information is collected over a secure connection and all payment transactions will be encrypted. Payment Card information is used solely for the purpose of processing payment for your advert. Kondo retains no record of Payment Card details.
? Information we request from you if you place an advert on the Website
If you place an advert on the Website, we will need to collect your email address to send you communications about how to access and manage your account (available within the Dashboard section of the Website). You can access this area at any time in order to update your details or change your options regarding marketing communications from Kondo and/ or selected third parties. Kondo will only use your information for marketing purposes where you have agreed to this.
We collect information in order:
i) to generate an overall audience profile of visitors using the Website. This information is then used to assist in developing relevant content on the Website.
ii) to administer the Website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes.
By submitting personal information to us, you are deemed to have agreed to the terms set out above regarding the use of your personal information.
Kondo may also contact you for research purposes.

Will I still need solicitor if I am using Kondo to sell my home?

Yes, you will still need a solicitor who will handle the legal process of selling your house. Although Kondo saves you the large fee of using an estate agent, you will still need to pay a solicitor's fee.

I’ve never sold a house before, so how will I know what to do?

Kondo will be there to guide you through the entire process; as a user, you will have access to many advice documents that will advise you on what to do next. As well as this, we have a team of experts that are always on-hand and contactable via email (info@kondo.co.uk).

If I want to remove my house from Kondo, how much notice do I need to give?

None – there are no contracts which means that you can remove your Kondo profile whenever you want.

If I want to, can I use Kondo and a local estate agent at the same time?

Why not? We’re flexible at Kondo, however if you do decide to use both parties at the same time, you should probably make your estate agent aware. You should also keep a record of anyone who shows an interest in your home as evidence; your estate agent could try to claim that they introduced the two of you to one another in the first place.
